Counselor Terms

These Counselor Terms (the “Addendum”) are an additional agreement between you and Sweet An Business LLC, doing business as “My School Advisor” (“we,” “us,” or “our”), that applies when you use the Service as an independent counselor. This Addendum supplements, and does not replace, our Terms of Service and Privacy Policy. Where this Addendum conflicts with the Terms of Service on a counselor-specific matter, this Addendum controls.

1. Who this Addendum covers

This Addendum applies to independent (“private”) counselors who sign themselves up for the Service. If your counselor account was instead provisioned by a school or district, your access is governed by the agreement between us and that institution (including any data privacy agreement), not by this Addendum.

2. The student-invitation relationship

You may access a student’s information only when that student (or their parent or guardian) has invited you and that invitation remains active. You may use the Service only to advise the students who invited you. A student or guardian may revoke your access at any time, and your access to that student’s information ends when the invitation is revoked.

3. Permitted use

You may use the Service and the information you access through it solely to provide college- and career-planning guidance to the students who invited you, within the Service and consistent with these terms and applicable law.

4. Prohibited use

You agree that you will not:

• scrape, crawl, bulk-export, copy, or reproduce the Service, its content, or any student data, except as the Service expressly allows;
• access the Service by automated or programmatic means, or attempt to extract data in bulk;
• resell, redistribute, or commercialize student data or the Service’s output;
• use the Service, its content, or data derived from it to build, train, or improve a competing product, model, or service;
• share your account credentials, or let anyone access the Service through your account;
• access or attempt to access any student who has not invited you, or any data beyond what your invitations grant.

5. Confidentiality and student data

Student information you access through the Service is confidential and belongs to the student and their family. You will keep it confidential, use it only as permitted above, protect it with reasonable safeguards, and not disclose it except as the student or guardian directs or as required by law. You will comply with all applicable privacy laws that govern you and the student information you access (including, where applicable, FERPA and state student-data-privacy laws), and use that information only to advise the student who invited you.

6. Notifying us of a data incident

If you become aware of any unauthorized access to, disclosure of, or loss of student information you obtained through the Service, you must notify us at privacy@myschooladvisor.app without undue delay and, in any case, within 72 hours after becoming aware of it.

7. Your professional responsibility

You are an independent professional. You are solely responsible for your own advice, conduct, and any licensure or credentials your work requires. The Service is a tool that supports your work; it is not your employer, supervisor, or professional adviser, and it does not direct or vouch for the guidance you give. You are responsible for your compliance with the laws and professional standards that apply to you.

8. Your authority to advise

You represent that you have the authority and any required consent to advise the students you serve through the Service, and that your use of the Service complies with applicable law.

9. Account security

Keep your password confidential and enable the security features we offer (such as multi-factor authentication). You are responsible for activity under your account. Notify us promptly at support@myschooladvisor.app if you suspect unauthorized use.

10. Suspension and termination

We may suspend or terminate your access if you violate this Addendum or the Terms of Service, or to protect students, other users, or the Service. Your confidentiality and data-use obligations survive termination.

11. AI guidance, no professional advice, and limitation of liability

The Service provides AI-generated guidancethat may be inaccurate, incomplete, or out of date and is not a substitute for professional judgment. The Service is provided “as is,” without warranties, and does not guarantee any outcome. To the fullest extent permitted by law, our liability relating to the Service is limited as set out in the Terms of Service.

12. Indemnification

You agree to indemnify and hold harmless Sweet An Business LLC from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your advice or conduct, or your violation of this Addendum, the Terms of Service, or applicable law.

13. Changes and contact

We may update this Addendum from time to time; we will update the “Last updated” date and, where appropriate, provide additional notice, and your continued use means you accept the updated Addendum. Questions? Contact us at support@myschooladvisor.app.
